We offer this Site, including all information, tools, and services available from this Site, to you, conditioned upon your acceptance of all the terms, conditions, policies, and notices stated herein.

Your continued use of this Site constitutes your full acceptance of these Terms of Use, as may be modified from time to time. These Terms also apply to our services offered on third-party platforms (e.g., Instagram, Pinterest, YouTube, or other social media platforms now existing or hereafter created).

• Any unauthorized access to or use of our servers or personal data;

In no event shall our total liability exceed the greater of (a) the amount paid by you for the product or service in question, or (b) one hundred U.S. dollars ($100).

Entertainment Purposes and Age Restriction

You must be 18 years or older to schedule or use any psychic or intuitive reading services. All services provided by Spiritual Essence are offered for entertainment purposes only and should not be construed as medical, psychological, legal, or financial advice.

You agree that you are solely responsible for any decisions you make based on the guidance provided. Spiritual Essence and its representatives are not liable for your choices, outcomes, or actions resulting from any service or advice provided.

Payments and Third-Party Processors

Payments for products and services are handled through third-party payment processors. By making a purchase, you agree to their respective terms and privacy policies. Spiritual Essence does not store full credit card information and cannot be held responsible for any breaches or errors caused by third-party processors.

Products and Services

We strive for accuracy in our product descriptions and pricing, but errors may occur. We reserve the right to correct such errors or cancel orders. Product images and descriptions are for illustrative purposes only.

All digital and custom products are non-refundable. Physical products may be eligible for replacement only in cases of verified damage upon delivery, supported by photographic proof.

Subscriptions

If you subscribe to recurring services, you authorize us to charge your payment method at each billing interval until cancelled. You may cancel at any time before the next renewal date. Refunds are not issued for partial billing cycles or unused portions.

Refunds and Cancellations for Readings

Changes to scheduled appointments must be made at least 48 hours in advance; cancellations must be made at least 72 hours in advance by emailing SpiritualEssence.life@gmail.com. Failure to comply will result in a charge of the full session fee. All completed readings and intuitive sessions are non-refundable.

Intellectual Property Rights

All content, including but not limited to text, graphics, images, designs, software, and logos, are the property of Spiritual Essence, JD Trading LLC, or its content suppliers and are protected by copyright and trademark laws. You may not copy, reproduce, distribute, or modify any part of this Site without prior written permission from Spiritual Essence.

Indemnification

You agree to indemnify, defend, and hold harmless Spiritual Essence, JD Trading LLC, its affiliates, employees, agents, and contractors from and against any claims, damages, liabilities, losses, or expenses (including reasonable attorney’s fees) arising out of or related to:

• Your use of the Site or any of its services;
• Your violation of these Terms;
• Your infringement of any third-party rights.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to conflict-of-law principles. You agree that any legal action or proceeding shall be brought exclusively in the state or federal courts located in Palm Beach County, Florida, and you consent to their jurisdiction.

Dispute Resolution and Arbitration

Any dispute, controversy, or claim arising out of or relating to these Terms or your use of the Site shall first be resolved through good-faith negotiation. If unresolved, it shall be submitted to binding arbitration under the rules of the American Arbitration Association (AAA) in Palm Beach County, Florida. Each party shall bear its own legal costs, and the arbitrator’s decision shall be final and binding. Class actions and jury trials are expressly waived.

Severability

If any provision of these Terms is found invalid or unenforceable, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall remain in full force and effect.

Waiver

Failure by Spiritual Essence to enforce any right or provision in these Terms shall not constitute a waiver of such right or provision.

Updates to These Terms

We reserve the right to modify or update these Terms at any time without prior notice. Updates will be posted on this page with the revised “Last Updated” date. Your continued use of the Site after such modifications constitutes acceptance of the updated Terms.
